反性骚扰法出台 漏洞百出

A human resources manager has become the first person jailed for sexual harassment (性骚扰)in the workplace under anti-discriminatory laws introduced in China in 2005.

Liu Lun, who worked in southwest China's Sichuan Province, faces five months behind bars after grabbing Chen Dan, a new employee, by the throat and kissing her after she refused his advances(求爱,示爱).

An article carried on the Beijing News emphasizes that there have been very few sexual harassment suits in which the victim has prevailed. It points to obvious flaws (瑕疵,漏洞)in the law.

The paper says the law doesn't provide specifications for defining, collecting evidence, or sentencing in sexual harassment cases. It notes the current law is too general to be implemented in real cases.

The paper further advises adding relevant articles in labor laws that obligate employers to provide a harassment-free working environment. And that could resolve some cases before they have to go to court, the paper says.
